This analysis provides a response to selected draft provisions for a new Libyan constitution published by thematic committees of the Constitution Drafting Assembly (CDA) in December 2014.
Progress has been made and there is much in the draft that is commendable.
Significant problems remain, however, both with respect to the coherence between the various sections and the substantive approach the drafters take to a number of key issues.
It is hoped that the identification of these problems and alternatives suggested in this analysis will inform the work as the drafting progress continues.
